Whiplash Compensation Guide
Whiplash is a common consequence of road accidents.
However, victims should remember that they do have certain rights of recourse and can claim compensation for whiplash injuries.
Covering the cost of medical treatment
The whiplash compensation amounts you recover can, if successful, help to give you some recourse for your injuries and can cover the cost of medical treatment or other losses you may have suffered such as loss of income if you are unable to work because of your accident.
The whiplash compensation amounts will depend on the losses for your particular circumstances. Remember, however, that your injuries should not be solely your fault if you want to make a successful claim.
In terms of the practicalities of making a claim, First4Lawyers has a streamlined system to reduce the stress to you.
After an initial consultation with you on the phone, your claim is passed to a duly qualified solicitor who will process the matter on your behalf. There are also often opportunities to proceed on a no win no fee basis (i.e., if you lose, you are not liable for legal costs). It is usual that the other party will meet your legal costs if your claim for compensation for whiplash is successful.
What can I expect to receive?
The amount of compensation that has been paid out following whiplash claims has varied wildly over the years, depending largely on the seriousness of the injuries and the losses incurred by the victim.
At the lower end of the scale, pay-outs for minor whiplash-related injuries, such as moderate neck and back pain leading to time off work, tend to start at around £750. Where the recovery from whiplash-related injuries exceeds a few weeks, the amount of compensation paid out rises above £1,000. When recovery from moderate whiplash injuries takes a number of months, compensation moves upwards towards the £2,550 mark.
Long-term injuries
In severe cases, whiplash-related injuries can cause permanent or recurring symptoms, such as restricted movement, recurring pain, or conditions like cervical spondylosis. In these cases, victims are entitled to compensation in the region of £8,150 to £14,000.
For the most serious cases of whiplash-related injuries, such as ruptured tendons, incomplete paraplegia or permanent quadriparesis, the compensation that victims can claim for reaches £30,000 to £90,000.
